Privacy Policy

Last updated: 26 October 2026

This policy explains how KineticAgentic handles personal information when you visit www.kineticagentic.co.za or contact us. We follow the Protection of Personal Information Act 4 of 2013 (POPIA).

1. Who is responsible for your information

KineticAgentic is the responsible party for the personal information described here. Our Information Officer can be reached at:

  • Email: sales@kineticagentic.co.za
  • Phone: 082 370 8831
  • WhatsApp: 082 889 2941

2. What we collect

We collect very little, and only what you choose to share or what is technically needed to run the website.

  • Enquiries you send us. If you email, phone or WhatsApp us, or use the email form on our home page (which opens your own email app), we receive your name, email address, phone number and anything you include in your message, such as details about your business or project. If you message us on WhatsApp, WhatsApp also processes that message under its own privacy policy.
  • Server logs. When you load the site, our hosting provider automatically records standard technical data: your IP address, browser and device type, the page requested, the referring page, and the date and time. This is used to deliver the site and keep it secure.

We do not ask for special personal information (such as health, religion or biometric data) or information about children. Please don't send us this kind of information.

3. Cookies, analytics and tracking

This website does not set any cookies, and it does not use analytics, advertising pixels, social media trackers or any other tracking technology. Fonts and images are served from our own domain, so loading the site does not send your information to third-party services. Because there are no cookies to consent to, there is no cookie banner.

If this changes, we will update this policy first and ask for your consent where the law requires it.

4. Why we use your information, and our lawful basis

  • To answer your enquiry and prepare a quote or proposal. This is needed to take steps you have asked for before entering into a contract, and is in your legitimate interest (POPIA section 11(1)(b) and (f)).
  • To deliver work you have contracted us for and to keep business, accounting and tax records (section 11(1)(b) and (c)).
  • To run and secure the website, for example detecting abuse or attacks, using server logs (our legitimate interest, section 11(1)(f)).

We do not sell your personal information, and we do not use it for automated decision-making or profiling. We will only send you direct marketing by email, SMS or other electronic messages if you are an existing client or have given consent, as section 69 of POPIA requires, and every message will give you a way to opt out.

5. Who we share it with

We share personal information only with service providers (operators) who help us run the business, such as our website hosting, email and cloud software providers. They may only process it on our instructions and must keep it secure and confidential. We may also disclose information where the law requires it.

6. Transfers outside South Africa

Our website is hosted, and some of our software tools are run, by providers whose servers may be outside South Africa (for example in the United States or Europe). Where your information is transferred outside South Africa, we only use providers that are bound by law, binding agreements or corporate rules that give a level of protection substantially similar to POPIA, as section 72 of POPIA requires.

7. How long we keep it

  • Enquiries that don't lead to work: we keep them for up to 12 months, then delete them, unless you ask us to delete them sooner.
  • Client records: for as long as we work together, and afterwards for as long as the law requires (for example, tax records are generally kept for five years under the Tax Administration Act).
  • Server logs: kept by our hosting provider for a limited period for security and troubleshooting, and not used to identify you.

8. How we protect it

We take reasonable technical and organisational measures to keep your information safe, as section 19 of POPIA requires. These include encrypted (HTTPS) connections to this site, strict browser security settings, access controls on the accounts we use, and keeping access to client information to what is needed. If we become aware of a security compromise affecting your personal information, we will notify you and the Information Regulator as POPIA requires.

9. Your rights

Under POPIA you have the right to:

  • ask whether we hold personal information about you, and request a copy of it;
  • ask us to correct, update or delete information that is inaccurate, out of date, excessive or no longer needed;
  • object to us processing your information on the basis of legitimate interest, and to direct marketing at any time;
  • withdraw your consent where we rely on it;
  • complain to the Information Regulator.

To use any of these rights, contact us using the details in section 1. We may need to confirm your identity first. We won't charge you for a simple request.

10. Complaints to the Information Regulator

If you are unhappy with how we have handled your information, please contact us first so we can try to fix it. You also have the right to lodge a complaint with the Information Regulator (South Africa):

  • Website: inforegulator.org.za
  • POPIA complaints: POPIAComplaints@inforegulator.org.za
  • General enquiries: enquiries@inforegulator.org.za

11. Links to other websites

This site may link to other websites. We are not responsible for how they handle personal information, so please read their privacy policies.

12. Changes to this policy

We may update this policy from time to time. The date at the top shows when it last changed.
